1. Scope and Operator
These General Terms and Conditions (the “Terms”) govern all reservations, bookings and stays at Villa Beaulieu, located at Via Arona 34, 7500 St. Moritz, operated by Trais Piz AG, Via Maistra 7, 7500 St. Moritz, Switzerland (company registration no. CHE-306.640.783) (“Villa Beaulieu”, “we” or “us”). They apply to the guest making the reservation and to all persons accompanying or staying with the guest (together, the “Guest”).
Any deviating terms of the Guest apply only if expressly agreed by us in writing. Individual written agreements always take precedence over these Terms.
2. Booking and Conclusion of Contract
A booking request may be made in writing, by e-mail, through our website or through an authorised booking channel. The accommodation contract becomes binding once we confirm the reservation in writing (including by e-mail). By completing or confirming a booking, the Guest accepts these Terms.
The Guest is responsible for ensuring that the details provided at the time of booking are complete and accurate. Bookings may only be made by persons aged 18 or over with legal capacity to contract.
3. Prices, Visitor’s Tax and Additional Services
All prices are quoted in Swiss Francs (CHF) and include statutory value added tax (VAT) at the applicable rate, unless stated otherwise. The price stated in the booking confirmation applies.
The statutory visitor’s tax (Kurtaxe) of the municipality of St. Moritz is charged per person and night and is not included in the room rate unless expressly stated; it currently amounts to CHF 3.25 per person and night in summer (May–October) and CHF 3.40 per person and night in winter (November–April), payable from the age of 12. A daily breakfast (coffee and a croissant) at the villa is included in the room rate unless stated otherwise; a more extensive breakfast can be arranged on request, is served at the Hanselmann and is charged separately upon departure. Additional services and consumption (for example food and beverages, spa, transfers or further services) are charged separately upon departure.
Prices may be adjusted in the event of demonstrable changes to statutory taxes, charges or duties occurring after the booking confirmation.
4. Payment, Deposit and Security
Depending on the rate plan and season, we may require a deposit or full prepayment to confirm the reservation. The amount and due date are stated in the booking confirmation.
We accept payment by the means stated in the booking confirmation (e.g. credit card – Visa, Mastercard – or bank transfer). We may request valid credit card details or a refundable security deposit as security for incidental charges and potential damage. The outstanding balance, together with any additional consumption, is due upon checkout, unless agreed otherwise.
In the event of late payment, we reserve the right to charge default interest at the statutory rate and reasonable reminder and collection costs.
5. Cancellation, Changes and No-Show
Cancellation and rebooking terms depend on the rate plan and are set out in the booking confirmation. They form an integral part of these Terms.
Unless the booking confirmation provides otherwise, free-of-charge cancellation is possible up to 5 days before arrival for stays from April to November, and up to 14 days before arrival for stays from December to March. Special conditions apply to the festive period (24 December to 6 January) and to non-refundable rates, as set out in the booking confirmation. Bookings made through third-party channels (for example Booking.com) are subject to the cancellation policy shown at the time of booking, which may provide for a uniform deadline of 14 days. In addition, the following applies:
Cancellations must be submitted in writing; the date of receipt by us is decisive.
In the event of a no-show or early departure, the full price of the reserved stay may be charged.
We will make reasonable efforts to re-let the accommodation; amounts actually received from re-letting will be credited against the cancellation charge.
We recommend that Guests take out suitable travel and cancellation insurance.
6. Arrival and Departure
Check-in is available from 15:00 and check-out is until 11:00 on the agreed dates. Early check-in or late check-out may be arranged subject to availability and may incur an additional charge.
We may require valid photo identification at check-in. If the Guest fails to arrive by the agreed time without notice, we may release the accommodation after a reasonable period, without prejudice to our claim to the agreed price.
7. Use of the Property and House Rules
The Guest undertakes to treat the property, its furnishings, equipment and all common areas with care and to use them only for their intended purpose. The Guest is responsible for the conduct of all accompanying persons and visitors.
The applicable house rules form part of the accommodation contract. We may give reasonable instructions to ensure the safety, order and quiet enjoyment of the property and its neighbourhood. Quiet hours are to be respected.
8. Number of Guests and Subletting
The accommodation may only be occupied by the number of persons stated in the booking confirmation. Any additional persons require our prior written approval and may incur an additional charge. Subletting or transferring the accommodation to third parties, or using it for events, commercial or other purposes not agreed, is not permitted without our prior written consent.
9. Smoking and Pets
Villa Beaulieu is a non-smoking property. Smoking is permitted only in designated outdoor areas. Out of consideration for our other guests, pets are generally not permitted; dogs may, however, be accepted by prior arrangement and with our written approval, and an additional cleaning fee may apply. In the event of a breach (including unauthorised smoking or pets), we reserve the right to charge for special cleaning and any resulting damage or loss of revenue.
10. Our Liability
We are liable in accordance with the applicable statutory provisions. We are not liable for loss of, theft of or damage to the Guest’s personal belongings, except where this results from our intent or gross negligence or where mandatory law provides otherwise. Where a safe is provided, valuables should be stored in it.
To the extent permitted by law, our liability for slight negligence is excluded, and any liability for indirect or consequential damage is excluded. Mandatory liability – in particular for injury to life, body or health – remains unaffected.
11. Guest’s Liability and Damages
The Guest is liable for any loss or damage to the property, furnishings or equipment caused culpably by the Guest, accompanying persons or visitors, in accordance with statutory provisions. Damage should be reported to us without delay. We may charge the reasonable cost of repair or replacement, including any loss of revenue while the accommodation cannot be re-let.
12. Force Majeure and Extraordinary Circumstances
Neither party is liable for the non-performance of obligations caused by events beyond its reasonable control (force majoure), including natural events, fire, official orders, epidemics or pandemics, strikes or interruptions to energy or communications supply. If such an event materially prevents the stay, both parties are released from performance to that extent; payments already made for services not rendered will be refunded, less any expenses unavoidably incurred.
13. Complaints
If the Guest has any cause for complaint, this should be raised with us without delay during the stay so that we have the opportunity to remedy the situation. Complaints notified only after departure may limit or exclude any related claims.
14. Data Protection
We process personal data collected during the booking process and the stay in accordance with our Privacy Policy and applicable Swiss data protection law (Federal Act on Data Protection, FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). Data is processed only to the extent necessary to perform the contract, to comply with legal obligations and for our legitimate interests. Our current Privacy Policy is available on request and on our website.
15. Severability
Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as possible to the intended economic purpose.
16. Amendments to the Terms
We may amend these Terms at any time with effect for the future. The version of the Terms in force at the time of the booking confirmation applies to the respective booking.
17. Applicable Law and Place of Jurisdiction
These Terms and the accommodation contract are governed by Swiss law, excluding the conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is St. Moritz, Switzerland. Mandatory places of jurisdiction provided for by law – in particular the protective jurisdiction available to consumers at their place of domicile – remain reserved and are unaffected.
